EXEMPTION FROM PARAGRAPH 702.65 (b) OF THE CANADIAN AVIATION REGULATIONS

Pursuant to subsection 5.9(2) of the Aeronautics Act, and after having taken into account that the exemption is in the public interest and is not likely to affect aviation safety, I hereby exempt the qualified L-39 pilots who work for hire and reward at Equipe de Voltige Northern Lights Inc./Northern Lights Aerobatic Team Inc. (NLAT) from the requirements set out in paragraph 702.65 (b) of the Canadian Aviation Regulations (CARs) that stipulates: No air operator shall permit a person to act and no person shall act as a flight crew member in an aircraft unless the person (b) where the aircraft is operated in IFR flight and persons other than flight crew members are on board, has successfuly completed a pilot proficiency check, the validity period of which has not expired, for that type of aircraft, in accordance with the Commercial Air Service Standards.

Purpose

The purpose of this exemption is to permit NLAT pilots to exercise the privileges of Aero Vodochody L-39 type rating as pilots without Pilot Proficiency Checks by Transport Canada. This exemption will allow the NLAT to conduct Combat Air Support operations with the Canadian Armed Forces.

Application

This exemption applies to the qualified pilots who work for hire and reward for NLAT while operating Aero Vodochody L-39, under Part VII Subpart 2 while conducting Combat Air Support, Aerial Work for the Canadian Armed Forces.

Conditions

This exemption is granted subject to the following conditions:

  1. The pilot-in-command must hold an Airline Transport Pilot Licence with a type rating for the L-39.
  2. Be qualified in accordance with section 3.10.2 of the NLAT manual.
  3. Hold a Type rating on the L-39 aircraft.
  4. Hold a valid Class 1, Group 1 IFR.
  5. Be trained on the L-39 aircraft in accordance with chapter 5 of NLAT operations manual.
  6. Have demonstrated type proficiency to the chief pilot by the mean of an annual pilot competency check.

Validity

This exemption is in effect until the earliest of the following:

  1. October lst, 2002;
  2. The date on which any condition set out in this exemption is breached; or
  3. The date on which this exemption is canceled in writing by the Minister where he is of the opinion that it is no longer in the public interest or is likely to affect aviation safety.
